This End-User License Agreement (“EULA”) is a legal agreement between you (either an individual, or a single entity) and the author of this software program.

By installing, copying, or otherwise excercising use of this software program, you agree to be bound by the terms of this license.

1. Grant Of License

The following rights are granted to the end-user by this license.

A. Installation: the end-user may install any number of copies of the software program as the end-user sees fit.

B. Distribution: the end-user is allowed to distribute the software in its original and unmodified form, including all files that were included in the software program's original distribution format.

2. Description Of Other Rights And Limitations

A. The end-user of this software program is explicitly not permitted to reverse engineer, decompile, or disassemble this software program, for any reason whatsoever.

B. This software program is licensed as a single product; with the exception of the Active Worlds(r) SDK, the component parts of this software program may not be separated for use on more than one computer.

3. Description Of Warranty

A. Because the software program is licensed free of charge, there is no warranty for the software program, to the extent permitted by applicable law. Except when otherwise stated in writing, the copyright holders, and/or other parties, provide the software program "as is" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The entire risk as to the quality and performance of the software program is with the end-user.

B. In no event, unless required by applicable law or agreed to in writing, will any copyright holder, or any other party who may modify and/or redistribute the software program as permitted above, be liable to the end-user for damages, including any general, special, incidental or consequential damages arising out of the use or inability to use the software program (including but not limited to loss of data or data being rendered inaccurate or losses sustained by the end-user or third parties or a failure of the program to operate with any other programs), even if such holder or other party has been advised of the possibility of such damages.

4. Description Of Export Restrictions

Portions of this software program contain use of cryptography which is subject to certain export restrictions of the United States Government.

If you are:

A. In a country to which export from the United States is restricted for anti-terrorism reasons, or a national of any such country, wherever located,

B. In a country to which the United States has embargoed or restricted the export of goods or services, or a national of any such country, wherever located, or

C. A person or entity who has been prohibited from participating in United States export transactions by any agency of the United States Government,

Then you may not install, download, access, use, or license this software program. These restrictons do not, however, deny you the ability to access the services provided by the software program; you are only barred from actually downloading and running the software.

By accepting this license, you warrant and represent that:

1. You do not match the criteria set forth in (a), (b), or (c) above,

2. That you will not export or re- export this software program to any country, person, or entity subject to u.s. export restrictions, including those persons and entities that match the criteria set forth in (a), (b), or (c) above, and

3. That neither the United States Bureau of Industry and Security, nor any other U.S. federal agency, has suspended, revoked, or denied your export privileges.
